Big name tuners are no longer selling "off road/race" tuning

I think they have gone too far at the EPA, One guy phones "Talk Radio" here quite regularly and claims one container ship spews out more pollution than all the cars in N.A. in a year.

Quit dumping sewage and garbage in the oceans.
 
Disclaimer: Am not taking a position, and am only offering a perspective.

No argument that there are sources of pollution outside of the US boundaries which seemingly do not care about the topic.

Can see the EPA's approach as it is pretty much an analogous move like when the Government inspects employers records for evidence of right to work and applies fines when the records are not in order.

In the case of the tuners, all they did was label the product as off-road only and then pretend that the customer would actually comply. In all reality, this was a sham as there was no real expectation of the customer limiting use to off-road only or enforcement thereof. Am confident that some did, and at the same time not confident that it was anything but a way around emissions regulations for others.

Sure, the EPA and / or States could go after individual offenders rather than the vendor, but this is the low hanging fruit of a single point versus high effort for many, and the vendor is likely culpable anyway by way of enabling. Just say-in.

Again, not endorsing one side or the other, just pushing the perspective.
 
Many abused the Diesel truck segment by repeat sooting offensive vids and that got the EPA interested.
 
PPEI is also stopping sales at the EPA's behest and receiving a fine(the amount has not been announced yet). When CUMMINS put in encryption a few years ago to block tuning, it didn't take long before companies came up with "patches" to get around it. So GM implemented encryption that is patented and above that which even the government uses, but you guessed it, HPtuners found somebody to physically open the ECM, swap the bootloader chip, and replaced it with one encrypted to there software to enable tuning. But the death nail has been social media, and everybody posting about it, laying out directions on how to do it, and who to call to do so, basically telling the EPA to kiss your hind end, while mooning them, and flipping them off, it was only a matter of time before the EPA AND the manufacturers would drop the axe.

It's always been illegal to modify your vehicle unless it had a CARB approval to go with it, but with social media and the diesel ricers out there rolling coal, it had brought unwanted attention from those who CAN bring it to a halt. There is already people on the "dark web" offering "deletes" for sale since the most recent crack down.

Right now there is a war brewing over CARB not being in line with the rest of the nation........legal issue here would be how can you legally apply a State regulation over all the other states?

The war right now is over CARB setting it's own MPG requirements, but as I understand it CARB is still the accepted standard in all 50 states for modification's.

I suspect that will become "the argument" if someone smart enough uses it. This evidences that its just not central government in DC that reaches into the states. It also is an argument against commandeering of state assets to enforce federal regulations.....five (5) US Supreme Court rulings say it can't be done constitutionally so the question becomes "how is it that Commiefornia standards become the rule over the entire country?"
 
PPEI, Sinister, Thoroughbred, and many more companies have all been raided in the last week weeks. The EPA took all their paper work, scanners, and searched every inch of their shops. They have a list of all their clients. The EPA has been watching everyone for a long time and is making a run at some big name companies right now. It's all about money. They wait till the company is big enough to pay millions in fines then they hammer down on them. It all comes done to money. And with private lawsuits over the clean air act that happened to the diesel brothers. No one is safe. All it takes is one phone call from an unhappy person and the EPA is at your door.

And if you don't think OBD3 isn't next your foolish. Big brother will be monitoring everything on your vehicle soon. And if they have it thier way you wont even be able to own a vehicle. But instead we will all share them. Alot of big people In the industry have been telling us about the changes coming around the bend. Its almost here.....
 
I agree with all the above except private ownership. That will still continue, Simply better economics. But heavier monitoring and regulation will occur.

Back years ago when I was with Mac tools & they started selling the ET50 made by Launch which they sold direct as ‘C-reader’ I knew what is coming long term. That is the 24hr loop recording tool with no wire that plugs into obd2. I sold hundreds of them, and many were sold as a “spy on your kids driving recorder”. I said in the first 5 minutes of it that car insurance companies will use this and now a few are. Soon ALL insurance companies will use it so they can prove you broke the law and therefore they don’t have to pay.

Now it is legal for cops to investigate your cell phone as evidence if you were using it while driving. It’s not a far leap for those obd2 recorders to be removed and downloaded as evidence also. It is a simple and under $50 “black box” for all rigs.

Adding the recording into the obd3 is not a hard thing and have it included when brakes apply as a mandate in the name of safety. It’s already included in most bcm units now.
 
Hate to tell you but newer OBDII cars already store that information. In crashes the info can all be retrieved from on board computer. They seize the car, fill out the court paperwork, and get all the info. So it's already being done.
